CineNexus Terms of Use

1. The app and its license

CineNexus provides tools for editing media on your device and creating an output from the material you choose. You may use the app only in accordance with these Terms, the applicable App Store terms, and applicable law.

For an app downloaded from the App Store, Apple’s Standard End User License Agreement applies unless a custom end user license agreement is provided with the app. It is available at Apple Standard End User License Agreement. These Terms supplement the applicable app license for the matters they address; they do not replace that license or override mandatory rights under applicable law.

The app and its original software, design, and materials remain the property of their respective rights holders. Permission to use the app does not transfer those rights to you.

2. Your ability to use the app

You must have the legal capacity or any parental or guardian permission required by the law that applies to you. Where permission or supervision is required, it is your responsibility and that of your parent or guardian to ensure it is provided.

The App Store age rating and the device’s restrictions should be considered when deciding whether the app is appropriate for a particular user. These Terms do not set a separate numerical age threshold.

3. Your media and permissions to use it

You retain the rights you hold in your videos, audio, images, and edited outputs. Using CineNexus does not transfer ownership of your footage to us. Because the app does not upload your videos to our servers for editing, these Terms do not grant us a license to publish or commercially exploit that footage.

You are responsible for having the rights and permissions needed to use, edit, export, and share your material. This can include copyright, music licenses, privacy rights, and permissions from people depicted in the material. The app does not give you rights to third-party content simply because you can edit it.

Before sharing an output, check that the intended use is lawful and that you are authorized to make it available to the intended audience.

4. Device permissions, local files, and exports

You choose the media the app can access through file selection and applicable iOS permissions. Refusing or withdrawing a permission can limit the operation that needs it. You can manage relevant permissions in iOS Settings.

Editing occurs on your device. Keep backups of original material you wish to retain, and review an exported file before relying on it or deleting an original. Available storage, device resources, system settings, and interruptions can affect an editing or export operation.

You control the destination of exports and any sharing action you initiate. Removing the app does not necessarily remove exported files or copies in other apps, cloud storage, or backups. You are responsible for managing those copies through the relevant service or device controls.

5. Advertising and external destinations

CineNexus displays advertisements. An advertisement is a separate promotional message and does not, by itself, constitute our endorsement or guarantee of the advertised product or service.

If you choose to open an advertisement or other external link, you may be taken to a service operated by someone else. Review that service’s terms and privacy notice before providing information or making a transaction. We do not control an external service, but nothing in these Terms removes any responsibility we have under mandatory law.

You can report a problematic advertisement to spanntoon@icloud.com. Include enough detail to help identify it, such as where and when it appeared.

6. Accounts, purchases, and subscriptions

The current CineNexus app does not require an account or login and does not offer in-app purchases or subscriptions. There is no CineNexus subscription to cancel or app account to delete.

Any separate transaction you choose to make with an advertiser or an external service is governed by the terms disclosed by that provider. Such a transaction does not create a CineNexus subscription.

7. Acceptable use

Do not use CineNexus to infringe intellectual property, violate another person’s privacy, create or distribute unlawful material, or facilitate fraud or other unlawful conduct.

Do not introduce malicious code, interfere with the app or its supporting services, attempt unauthorized access, or use automated activity to disrupt advertising or other service functions.

Do not copy, modify, distribute, or reverse engineer the app except where the applicable license or law permits it. This restriction does not limit rights that cannot lawfully be restricted, including rights under applicable open-source licenses.

8. Availability and changes to the service

We may update the app to maintain it, address problems, or change features. App operation can depend on your device, iOS version, available storage, and external services. We do not promise uninterrupted operation or that every input file will produce the result you expect.

Where reasonably possible, we will give appropriate notice of a change or discontinuation that materially affects your use, and we will respect any notice, remedy, or other obligation required by applicable law. Changes do not remove rights you already have under mandatory consumer law.

9. Warranties and responsibility

To the extent permitted by applicable law, the app and related services are provided on an “as available” basis. You should review your work and maintain appropriate backups. This statement does not exclude a statutory guarantee, required standard of care, or remedy that applies to the service.

Any limitation of responsibility in these Terms applies only to the extent allowed by applicable law. Nothing excludes or limits liability that cannot lawfully be excluded or limited, including liability for fraud, deliberate misconduct, or other protected claims. Your mandatory consumer rights remain in effect.

Responsibility for a loss will be determined under the applicable law, including the cause of the loss, each party’s conduct, and any duties that cannot be excluded. These Terms do not require you to waive a remedy that the law guarantees.

10. Stopping use and changes to these Terms

You may stop using CineNexus at any time and remove it from your device. Manage any exported files and backups separately if you also want those copies removed. Stopping use does not affect rights or obligations that arose before you stopped.

We may revise these Terms to reflect changes to the app or applicable requirements. We will update the effective date and provide any notice or opportunity to review and agree that the law requires. A revision does not retrospectively remove accrued rights or replace a consent that must be obtained separately.

11. Applicable rights and contact

These Terms do not select a jurisdiction that displaces the mandatory protections available to you. Applicable law and the competent court or other dispute-resolution body are determined under the rules that apply to your circumstances and the applicable app license.
